Welcome to Lead Shark AI (“we”, “us”, “our”). These Terms of Service (“Terms”) govern your access to and use of our website, products, services, and related software (collectively, the “Services”). By using our Services you agree to these Terms.

1. Acceptance of Terms

3. Services & Subscriptions

We offer website, CRM, and automation services under monthly subscription plans. Details of what each plan includes are available on our pricing page and in your service order. We may modify, suspend, or discontinue parts of the Services at any time.

4. Payment & Billing

  • Subscription fees are billed in advance on a recurring monthly basis unless otherwise stated.
  • All fees are non-refundable except as expressly stated in these Terms or required by law.
  • You are responsible for providing valid payment information. We may suspend Services for failed payments.

5. Free Trials & Guarantees

If a trial or guarantee is offered, its duration and terms will be clearly stated. We reserve the right to revoke trial access at our discretion in cases of abuse.

6. Cancellations & Refunds

You may cancel your subscription at any time from your account dashboard or by contacting support. Cancellation takes effect at the end of your current paid period. Refunds are provided only as described in our pricing or promotional terms.

7. User Responsibilities

You are responsible for:

  • Supplying accurate contact and billing information;
  • Complying with all applicable laws when using the Services;
  • Maintaining the security of your account credentials.

8. Prohibited Content & Conduct

You agree not to use the Services to host, send, or store illegal, infringing, abusive, or harmful content. We may suspend or terminate accounts that violate these rules.

9. Intellectual Property

All Services, code, designs, and materials provided by Lead Shark AI are our property or that of our licensors. You are granted a limited, non-exclusive right to use the deliverables for your business as described in your agreement. You must not copy, resell, or redistribute our proprietary software or materials without our written permission.

10. Client Content & License

You retain ownership of the content you provide (text, images, logos). By submitting Content to Lead Shark AI you grant us a worldwide, royalty-free license to use, reproduce, and modify it for the purpose of providing the Services.

11. Third-Party Services & Integrations

We integrate with third-party tools (payment processors, CRMs, SMS gateways, etc.). Your use of those services is subject to their terms and privacy policies. We are not responsible for third-party outages or behavior.

12. Warranties & Disclaimers

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

13. Limitation of Liability

IN NO EVENT WILL LEAD SHARK AI BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES. OUR AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS SHALL NOT EXCEED THE AMOUNTS PAID BY YOU IN THE THREE (3) MONTHS PRECEDING THE CLAIM.

14. Indemnification

You agree to indemnify and hold harmless Lead Shark AI and its officers, employees, and agents from any claim arising from your use of the Services or violation of these Terms.

15. Confidentiality

Each party agrees to protect the other party’s confidential information and to use it only for performing obligations under these Terms.

16. Data & Privacy

Our collection and use of personal data is described in our Privacy Policy. You agree that we may process personal data to provide the Services.

17. Termination

We may suspend or terminate your access for breach of these Terms or illegal conduct. Upon termination, your access to the Services will cease and outstanding fees remain payable.
